Explanation
These are the official Rules and Regulations for the 2010 Loggerhead Fit Weight Loss Challenge – a 90 Day, skill-based, Weight Loss Competition, which incorporates a physical transformation and questionnaire managed by Loggerhead Marketing, LLC.

 This Competition will be conducted in the United States and will be open to residents of the United States, its territories, and possessions only.

Eligibility and Requirements
Loggerhead Marketing, LLC reserves the right to interpret these rules and, if necessary, to amend the rules at its sole discretion and without notice to individual Competitors. Any amendments to the rules or changes in prizes will be published online at www.LoggerheadFit.com. Rule interpretations and all judging decisions are final. All information and materials submitted along with your Official Competitor Forms become the sole and exclusive property of Loggerhead Marketing, LLC. Competitor ratings are proprietary to Loggerhead Marketing, LLC and will not be disclosed. Loggerhead Marketing, LLC shall have the sole right in its sole discretion to disqualify any Competitor without explanation for any reason at any time during the Competition, and Loggerhead Marketing, LLC shall be fully and completely released and discharged from any liability or responsibility in this regard.

By entering in the Competition you assume all risk of injury, harm or loss of any kind arising from participation in the Competition. Please consult with your physician or health care provider before starting any new exercise or nutrition program, particularly if you suffer from any medical condition or regularly use prescription or over-the-counter medications. It is recommended that you consult with a qualified trainer or coach, if you are not experienced with strength training, or if you are changing your exercise program. By entering this Competition, you also expressly release Loggerhead Marketing, LLC, its distributors and affiliated companies, and the directors, officers and employees of any of them from all risk, loss, injury, damage or harm that may arise from participating in the Competition.

Competition Entrants must be at least 18 years of age and legal residents of the United States, its territories and possessions, before the official start date of their competition. Competition is subject to applicable federal, state, and provincial laws and is void where prohibited.

Competitor's Entry Fees must paid in full, on or before, the Competitor's Official Completion Date. 

The Entrants Competitor’s Forms must be submitted within 15 days of their Official Completion Date, which includes completed forms, weight loss story, and all required, dated, before and after pictures. Required before and after pictures include: relaxed front, relaxed back, and relaxed side. Optional before and after pictures include: flexed muscle front and flexed muscle back.

Employees of Loggerhead Marketing, LLC, its affiliates, subsidiaries, and any of their advertising, promotion and internet agencies, or consultants and contractors providing services for the Loggerhead Fit Weight Loss Challenge, and their family members, along with all those with whom they are domiciled, may participate, but are NOT eligible to win.

Competition Entrants may NOT use anabolic steroids or any strength-enhancing prescription drugs or medications unless prescribed by a licensed physician to treat an existing medical condition (*medication and medical condition must be noted in the Competitor’s Forms). A medical note from the prescribing physician may be required.

Entrants may use any weight loss or exercise/nutrition program of their choosing during the competition.

It is the Entrant’s responsibility to cancel their membership to LoggerheadFit.com within the 15-day Refund Policy.  Refunds will not be given due to the irresponsibility on the Entrant.

If any winner is under the age of 21, Loggerhead Marketing, LLC reserves the right to require the signature of a parent or legal guardian on any documents.

Competition Entrants must notify Loggerhead Marketing, LLC in writing of any change of address or phone number. Winners who cannot be reached within fourteen (14) days at the address or phone number in their Official Competitor’s Forms will be disqualified.

Entering this Competition is not a guarantee that you will lose weight or change your body. There are no “typical” results, however, it has been proven that through proper exercise and nutrition significant results can be achieved. As individuals differ, their results will differ, even when using the same program.

By submitting your completed Official Competitor’s Forms you are expressing consent and permission for Loggerhead Marketing, LLC, and any of its affiliated companies, to use your name, photographs and written responses (in whole or in part) for promotional and advertising purposes to promote Loggerhead Marketing, LLC, its business, and the Loggerhead Fit Weight Loss Challenge, in any media and in any manner whatsoever, without limitation or restriction or further consideration of any kind, and such consent is deemed given by your entry and participation in the Competition.

Submission of your completed Official Competitor’s Forms shall be deemed as your acceptance of these Rules and Regulations (as may be amended) and your voluntary transfer to Loggerhead Marketing, LLC of all right, title, and interest, including copyright, of your photographs and written responses.

Competition Timeline & Deadlines
To enter the Loggerhead Fit Weight Loss Challenge, visit www.Loggerheadfit.com, view the details and sign up. After you successfully sign up, you will be directed to the Members Website, www.LoggerheadFit.com/members, where you can download the Competitor’s Forms. 

Competitors may choose any date as their Official Start Date, as long as their Official End Date is 90-days following the Start Date. Any incorrect or irregular dates listed in the Entrant’s submitted Official Competitor’s Forms may be disqualified.

Upon completing the 90-day Weight Loss Challenge, you must send the completed Competitor’s Forms, which must be in English, within 15 days of your Official Completion Date, to be eligible to win any prizes, by mail or express courier (FedEx, UPS, etc.) to: Loggerhead Fit Weight Loss Challenge / Loggerhead Marketing, LLC, 5703 Red Bug Lake Rd, Suite 114, Winter Springs, FL 32708. All Official Competitor’s Forms must be postmarked within 15 days of the Official Completion Date. Incomplete and illegible entries will be disqualified. All documents, stories, and “before” and “after” photos, must be previously unpublished and original. All entries must be postmarked on, or before April 15, 2011 to be eligible for the 2010 Loggerhead Fit Weight Loss Challenge. Any entries postmarked after April 15, 2011, will automatically be entered in the 2011 Loggerhead Fit Weight Loss Challenge, if applicable. Loggerhead Marketing, LLC is not responsible for mail delays, misplaced, or lost entries.

Competition Entrants may participate in the 2010 Loggerhead Fit Weight Loss Challenge more than once. However, each Entrant must complete a full consecutive 90-day program (“1 Round”) in order to be eligible to win and before starting another round. If an Entrant chooses to compete in more than one round, then all of the above stated requirements must be met for each round, the starting and ending dates of each round must NOT overlap with one another, and a different set of Competitor’s Forms must be submitted for each round in order to be eligible for any prizes.

Winners will be announced on or before May 15, 2011 on www.LoggerheadFit.com, as well as www.LoggerheadFit.com/members. Competitors may also send a separate, self-addressed, stamped business size envelope, which must be received by May 31, 2011, to Loggerhead Fit Weight Loss Challenge Winners List, 5703 Red Bug Lake Rd, Suite 114, Winter Springs, FL 32708, to receive a complete list of Winners.

Competitor's must start by December 31, 2010 in order to be eligible for the 2010 Loggerhead Fit Weight Loss Challenge.

Judging Process
The Loggerhead Fit Weight Loss Challenge competitors will be judged by a panel of, no less than, 3 judges. Each judge will adhere to the following criteria when scoring each Entrant: Physical Change (“before” and “after” pictures – 25% total score, body fat % - 50% total score), and Weight Loss Journey (weight loss story – 25% total score). Winners will be chosen for each category in accordance with the “Prizes” section of these Rules and Regulations. Each competitor’s likelihood of winning depends upon the number of entries received, and the quality of your entry compared to the quality of all other entry submissions as determined by the judges. In the event of a tie, the Entrant with the most body fat % lost wins.

Monthly prizes judged solely on body fat %. The Competitor with the highest body fat % lost will win the awarded prize.

Submission of your completed Official Competitor’s Forms shall be deemed as your acceptance of the judge’s decisions, and that you accept and agree that all judgments are final.

Prizes Structure, Phases, and Approximate Retail Values
The Loggerhead Fit Weight Loss Challenge follows a Dynamic Prize Structure (DPS) – a prize structure that is organized where the prize value and quantity increases as the number of competitors increases. 20% of the Net Income from each competitor will be placed into the DPS Fund. The DPS incorporates 3 different phases, each increasing with value, from Phase 1 (lowest value) to Phase 3 (highest value). The movement from one phase to the next is based solely on the monetary value of the DPS Fund. When the DPS Fund increases to an amount that is substantial enough to warrant the movement to the next phase, it will be announced on www.LoggerheadFit.com, as well as www.LoggerheadFit.com/members. 

The phases are as follows:

Phase 1 – One Grand Prize winner will be awarded the Loggerhead Fit Entertainment Package which consist of a minimum 32” Flat Screen HDTV, a Blu-ray* DVD Player, plus 2 months worth of free rentals from Netflix*. Total prize value of approximately US$850.00.

Phase 2 – Phase 1 plus one (1) second place winner and one (1) third place winner.  Second place winner prize consists of the Loggerhead Fit Wii* Gaming Package which includes the Wii* Gaming Console, plus a Wii Fit* Bundle. Total prize value of approximately US$450. Third place winner prize consists of a Flip MinoHD High-Definition Camcorder*.  Total prize value of approximately US$225.

Phase 3 – Phase 2 plus the addition of fourth and fifth place winners.  All prizes are split into two (2) different categories – Men & Women. This means that there will be one (1) male and one (1) female winner for each place. Fourth place winner prize consists of a Digital Camera. Total prize value of approximately US$125. Fifth place winner prize consists of an iPod Shuffle* plus $20 worth of gift cards to itunes*.   

In addition to the above stated prizes, competitors may also be awarded monthly prizes during the month of their Official Completion Date, at the discretion of Loggerhead Marketing, LLC.  Entrants must submit their completed Official Competitor’s Forms to be eligible for monthly prizes. Prize will be valued at, no less than, US$20. Minimum of two (2) Competitors completed within the same month.

A minimum of fifty (50) Entrants must be met to enter Phase 1 of the stated DPS. If the minimum is not met, then the Grand Prize winner will be offered a prize substitution, at the discretion of Loggerhead Marketing, LLC, as allotted by the value of the DPS Fund, at the conclusion of the 2010 Loggerhead Fit Weight Loss Challenge.

Prize values stated as approximates to the recommended retail value as provided by the supplier(s) and are correct at time of printing. All prize values (or where relevant, possible maximum value), are in US dollars. Loggerhead Marketing, LLC takes no responsibility for any variation in prize values.

All winners are responsible for all applicable taxes; prizes are not transferable; and there will no substitutions for the prizes except at the option of Loggerhead Marketing, LLC in the event of unavailability. All winners may sign a declaration and release form confirming compliance with the contest rules, acceptance of the prize as awarded and releasing Loggerhead Marketing, LLC  and its affiliates, its advertising and promotion agencies, the contest judges and their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with the Loggerhead Fit Weight Loss Challenge, the entrant’s participation therein and/or the awarding and use of the prize or any portion thereof.

Loggerhead Marketing, LLC does not necessarily adopt or endorse, and does not accept any liability for, any statements or claims that are made by any retailer or partner or associate, or website content that is posted on retailer or partner or associate sites.

Failure by Loggerhead Marketing, LLC to enforce any of its rights at any stage does not constitute a waiver of those rights.
